Terms of Service

These Terms of Service ("Terms") govern your access to and use of bgly.net, including our website, background removal tools, account features, credits, subscriptions, and any related services (collectively, the "Service"). The Service is operated by the operator of bgly.net ("we", "us", or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

bgly.net provides an online background removal tool. You upload an image, we process it using automated segmentation technology (including third-party AI infrastructure), and you receive a cutout or related output for preview and download.

The Service may include:

• Free daily quota, signup credits, check-in rewards, and promotional credits (subject to change)
• Paid subscriptions (Lite, Pro) and one-time credit packs
• Standard and HD processing modes
• Preview and Max download options
• API access for eligible paid accounts (when available)

Feature availability, pricing, credit costs, and limits are described on our website and may change from time to time.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country to consent to data processing, if higher) to use the Service. The Service is not directed at children, and we do not knowingly allow children to create accounts or use paid features.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts and access

Some features require an account. You are responsible for keeping your login credentials secure and for all activity under your account.

We may suspend or terminate access if we reasonably believe you have violated these Terms, our Acceptable Use Policy, or applicable law, or if your use poses risk to the Service, other users, or third parties.

We may limit concurrent jobs, daily free quota, API rate limits, or other usage to protect the Service and prevent abuse.

4. Free use vs paid use

4.1 Free and guest use

Without a paid plan or purchased credits, you may use the Service only within the free quota and promotional limits we publish. Free and guest results are for personal, non-commercial use only, unless we explicitly state otherwise on the pricing page at the time of use.

Free users may be subject to additional restrictions, including:

• Limited download options (for example, Max-resolution download may require a paid plan)
• Credit charges for certain downloads or operations
• Shorter retention of tasks or outputs compared to paid accounts

4.2 Paid subscriptions and credits

If you purchase a Lite, Pro, subscription, or credit pack, additional benefits may apply as described on our pricing page, including:

• Monthly or yearly credit grants
• Commercial license for outputs generated while your paid access is active (subject to Section 5)
• Unlimited downloads in the sense that eligible paid users are not charged credits again for Preview or Max downloads of a given result, as described on the product
• Priority or expanded support where offered

Purchases are subject to our Refund Policy. Credits may expire according to the plan or pack terms shown at checkout.

4.3 No resale of the Service

You may not resell, sublicense, or offer the Service itself to third parties except through features we explicitly provide (such as an official API for authorized accounts).

5. Your images and our license

5.1 Your content

You retain ownership of images you upload ("Input") and outputs we generate for you ("Output"), subject to third-party rights in the underlying content.

You represent and warrant that:

• You have all necessary rights, licenses, and permissions to upload and process each Input
• Your Input and your use of Output do not infringe any copyright, trademark, privacy, publicity, or other rights
• Your Input complies with our Acceptable Use Policy

5.2 License you grant us

To operate the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, transmit, reproduce, process, and display your Input and Output only as needed to:

• Run background removal and deliver results to you
• Store task history for your account (where applicable)
• Prevent abuse, secure the Service, and comply with law
• Enforce these Terms

We do not claim ownership of your Input or Output.

5.3 No training on your uploads (default)

Unless we ask for your separate, explicit consent (for example through an in-product opt-in), we do not use your uploaded images to train our own or third-party machine learning models. Processing through infrastructure providers (such as model APIs) is limited to fulfilling your request.

5.4 Commercial use of Output

Commercial use (including use in product listings, advertising, client work, or resale of edited images) is permitted only if you:

1. Have an active paid plan or purchased credits that includes a commercial license at the time you generate or download the Output, and
2. Have the right to use the original Input commercially, and
3. Comply with applicable law and third-party platform rules.

Free-tier Output is not licensed for commercial use unless we state otherwise in writing.

6. Acceptable use

You must not misuse the Service. Prohibited conduct includes uploading or processing content that is illegal, harmful, infringing, or abusive. Details are in our Acceptable Use Policy, which is incorporated into these Terms by reference.

We may remove content, cancel tasks, revoke credits, or terminate accounts for violations.

7. Restrictions

You agree not to:

• Reverse engineer, scrape, or bulk-access the Service except through documented APIs we provide
• Bypass rate limits, quotas, payment requirements, or security measures
• Use bots or scripts to abuse free quota or promotional programs
• Upload malware or attempt to disrupt the Service
• Misrepresent affiliation with bgly.net or remove required notices

8. Third-party services

The Service relies on third-party providers (for example, AI processing, cloud storage, payment processors, analytics, and email). Your use may be subject to their terms and policies. We are not responsible for third-party websites linked from our site.

Payment card data is handled by our payment processors; we do not store full card numbers on our servers.

9. Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE". Background removal is automated and may be imperfect (for example, around hair, glass, shadows, or fine edges). We do not guarantee that Output will meet marketplace, print, or legal requirements.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless the operator of bgly.net and its affiliates, officers, agents, and suppliers from claims, damages, losses, and expenses (including reasonable legal fees) arising from your Input, your use of Output, or your violation of these Terms or applicable law.

12. Privacy

Our Privacy Policy explains how we collect and use personal data and how we handle uploaded images. By using the Service, you acknowledge that you have read the Privacy Policy.

13. Term and termination

These Terms apply from your first use of the Service until your access ends. You may stop using the Service at any time. We may suspend or terminate the Service or your account as described above.

Upon termination, your right to use the Service stops immediately. Sections that by nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

14. Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. If changes materially affect your rights, we may provide additional notice (for example, by email or in-product notice). Continued use after the effective date constitutes acceptance, except where applicable law requires otherwise.

15. General

If any provision of these Terms is held invalid, the remaining provisions remain in effect.

These Terms, together with the Privacy Policy, Acceptable Use Policy, and any plan-specific terms shown at checkout, constitute the entire agreement between you and us regarding the Service.

Governing law and disputes: These Terms are governed by the laws applicable to the operator of bgly.net, without regard to conflict-of-law rules. Courts with jurisdiction over the operator may hear disputes arising from these Terms or the Service, unless mandatory consumer protection rules in your country require otherwise.

The English version of these Terms controls if there is a conflict with a translation.
